Leaving New Jersey: Effectively Changing Tax Residency

With the new reduction in the deductibility of state and local taxes, many clients are exploring leaving New Jersey. Although changing a client’s residence from a high-tax state (i.e., NJ, NY) to a low, or no-tax state (i.e., FL) can dramatically reduce the amount of state taxes paid, high-tax states have inflexible residency rules and do not let their residents leave easily. We will identify state tax residency rules and methods to effectively change tax domicile, and explore planning opportunities to minimize state income and inheritance taxes. New Jersey and Florida tax attorney, Parag Patel, of, has counseled numerous clients in tax residency planning.

Frank Czekay is a Firm Director in the State and Local Tax Services (SALT) Group of Baker Tilly Virchow Krause, LLP's Philadelphia office. Frank is responsible for all aspects of multistate tax planning, research, voluntary disclosure projects and merger and acquisition due diligence projects for corporate, pass-through and individual clients. Frank has over 25 years experience in serving multistate corporate clients and pass-through entities.

Frank received his Bachelor of Science degree in Accounting from the Pennsylvania State University, his Juris Doctor from Case Western Reserve University School of Law, and his Master of Laws in Taxation from Villanova University. He is admitted to the bar in the States of Pennsylvania and New Jersey. He is also a certified public accountant, licensed to practice in the Commonwealth of Pennsylvania.

Frank is the immediate past president of the Greater Philadelphia Chapter of Pennsylvania Institute of Certified Public Accountants a former member of the Greater Philadelphia Chapter Executive Board and a member of the State Tax Committee and the Local Taxation and Government Committee. He is also a member of the Philadelphia Revenue Commissioner’s Tax Advisory Board. Frank also is an instructor for various state tax courses for the Pennsylvania Institute of Certified Public Accountants and an adjunct faculty member at Rowan College at Burlington County.

Mr. Patel is the 2011/12 chairman of the Tax Law Committee of American Bar Association’s GP Solo and Small Firm Division. He also serves as a part-time municipal court judge for Edison Township, New Jersey. Mr. Patel is a graduate of Georgetown (J.D.) and New York University (LL.M. tax) law schools. He is a member of the New Jersey State, New York State, Middlesex County and American Bar Associations.
