This presentation will provide a comprehensive overview of key employment law topics and issues particularly relevant to the New Jersey employer – big and small. The topics covered will include: protected categories under federal law and the New Jersey Law Against Discrimination; an overview of the federal Fair Labor Standards Act, including the exemptions, misclassification issues and the proposed new FLSA Regulations; employee whistleblower protection under the New Jersey Conscientious Employee Protection Act; statutory leave rights under the federal Family and Medical Leave Act and the New Jersey Family Leave Act; and other current issues in employment law affecting the workplace such as social media policies in the workplace and the nationwide movement towards implementing paid sick leave.

He is a member of the National Academy of Elder Law Attorneys, Monmouth County Probate and Estate Committee, the Monmouth County Chancery Practice Committee, the Monmouth County Elder Law Committee, and the Monmouth County Family Law Committee. He manages the firm’s services for clients seeking Veterans benefits, Medicare coverage and eligibility for state funded programs for health and medical benefits. He litigates denials of long-term care and eligibility benefits by governmental agencies at fair hearings, administrative law proceedings and direct appeals to the Appellate Division of the New Jersey Superior Court. He speaks at seminars and conferences, including Continuing Education Units ("CEU’s”) on nursing home and community based alternatives to institutional care, the Nursing Home Reform Law and Veterans benefits, including Continuing Education Units ("CEU’s”), and he is a noncredit instructor for the Rutgers School of Social Work, Office of Continuing Education on the topics of Medicaid Changes and Veterans Benefits. He heads the elder law and probate sections of the firm. Mr. Niemann is also a member of the Monmouth County and New Jersey State Bar Associations, the U.S. Federal District Court of New Jersey, and the U.S. Third Circuit U.S. Court of Appeals.

As a commercial litigator with more than 20 years of experience, Ms. Wells represents management in all types of employment-related matters, including wrongful discharge, discrimination, harassment, retaliation, wage and hour issues and other business-related torts. In addition to regularly appearing before the state and federal courts in New Jersey, she routinely handles matters before numerous administrative agencies, including the Equal Employment Commission, the United States Department of Labor, the New Jersey Division on Civil Rights and other administrative agencies.
